THE STATUTES

Statute No. 1

MEMBERSHIP OF CONVOCATION

Short title

1.  This statute may be cited as the James Cook University Statute No. 1 (Membership of Convocation) 1997.

Commencement

2.  This statute commences on the commencement of section 57 of the James Cook University Act 1997.

3.  The convocation of the university consists of the following:

Statute No. 2

CONDUCT OF COUNCIL ELECTIONS

Short title

1.  This statute may be cited as the James Cook University Statute No. 2 (Conduct of Council Elections) 1997.

Commencement

2.  This statute commences on the commencement of section 57 of the James Cook University Act 1997.

Rolls of electors of the convocation

3.       (1)  For the purposes of an ordinary election of members of the convocation to the council, the registrar is to prepare and maintain a roll of electors which is to contain the names of all members of the convocation.

(2)  Each member recorded in the roll of electors must keep the registrar informed of the member's address.

(3)  The roll of electors is to be kept in such form as the registrar thinks fit.

Rolls of electors of staff

4.       (1)  The registrar is to prepare and maintain -

    (a)  a roll of electors for the academic staff members of the council which is to contain the names of the academic staff;
    (b)  a roll of electors for the full-time general staff members of the council which is to contain the names of the full-time general staff.

(2)  The rolls are to be kept in such form as the registrar sees fit.

Conduct of elections

5.       (1)  All elections referred to in this statute must be conducted by the registrar.

(2)  The registrar's decision on all matters affecting an election will be final.

(3)  The registrar may delegate to an appropriately qualified person all or any of the powers given to the registrar under this statute.

Notice of election

6.       (1)  In respect of all elections of members of the council under this statute, the registrar is to publicly notify electors of:

    (a)  the day determined for holding the election;
    (b)  the number of seats to be filled;
    (c)  the form in which nominations must be made;
    (d)  the day and time by which nominations must reach the registrar.

(2)  In respect of the election of members of the convocation the notification in 6(1) is to be: circulated within the university by letter or other appropriate method; and be published in newspapers circulating generally throughout North Queensland and in a newspaper with Australia-wide circulation.

(3)  In respect of the election of members of the academic staff and the full-time general staff the notices are to be circulated within the university by letter or other appropriate method.

Number of nominations

7.  If at any election of members of the council -

    (a)  there are no nominations, the registrar is to take the action prescribed in section 8 in respect of those seats or the casual vacancies;
    (b  the number of nominations is less than the number of seats or casual vacancies to be filled, the registrar is to declare the persons nominated to be elected and take the action prescribed in section 8 in respect of those seats or casual vacancies remaining unfilled;
    (c)  the number of nominations is equal to the number of seats or casual vacancies to be filled, the registrar is to declare the persons nominated to be elected;
    (d)  the number of nominations exceeds the number of seats or casual vacancies to be filled, an election must be held in accordance with the Procedures for the Election of Members of Council.

Registrar to inform Minister of vacancies

8.  If a seat or casual vacancy is not filled for any reason, the registrar must inform the Minister of the number of seats or vacancies remaining unfilled and the Minister is to take whatever action the Minister deems appropriate in accordance with subsection (1) of section 21 of the Act.

Statute No. 3

FEES

Short title

1.  This statute may be cited as the James Cook University Statute No. 3 (Fees) 1999.

Fees

2.       (1)  The Council may make Rules regarding the payment of fees -

    (a)  for examinations; and
    (b)  for attendance at lectures and classes of the university; and
    (c)  for the use of the university's facilities;

and the amount, time and mode of payment of any such fees.

Statute No. 4

MAKING AND NOTIFYING OF UNIVERSITY RULES

Short title

1.  This statute may be cited as the James Cook University Statute No. 4 (Making and Notifying of University Rules) 1999.

Making university rules

2.  Under this statute the council may make rules to give effect to any statute made under the Act.

Notification

3.  Rules must be notified by a nominee of the Registrar making them available either:

    (a)  on a noticeboard in the foyer of the Humanities II Building or another noticeboard designated by the Registrar; or
    (b)  on the university's website on the internet.
