Intent
This Policy has been established to ensure and enable the completion of mandatory training requirements implemented by James Cook University (JCU, the University) to be completed by all Staff Members as a condition of their employment, ensuring compliance with relevant legislation and University policies and procedures, and a safe and respectful working and learning environment. This Policy supports the James Cook Compliance Framework and Compliance Policy.
Scope
This Policy applies to all Staff Members covered by the James Cook University Enterprise Agreement.
Definitions
Except as otherwise specified in this Policy, the meaning of terms used are as per the Human Resources Policy Glossary.
Policy
1. Commitment
1.1 The University is committed to:
a. Ensuring that it complies with all applicable laws and regulations, and that it strives to meet the requirements of those statutory obligations, standards and codes of practice that apply to its day-to-day activities and responsibilities.
b. Ensuring all Staff Members understand their rights, responsibilities and statutory obligations in relation to the provision of a safe and effective workplace for Staff, and a safe learning environment for its Students.
1.2 This will be achieved through:
a. Providing Staff Members with information, training and resources to equip them to meet statutory obligations and manage risks.
b. Leadership at all levels demonstrating accountability and commitment to training.
c. Using educative approaches for the prevention of bullying, discrimination, harassment and sexual misconduct.
d. Providing Continuing, Fixed-Term and Casual Staff Members with the appropriate time and support to complete the mandatory training during work hours.
e. Making employment at JCU conditional upon Staff Members completing mandatory training on commencement of, and throughout the course of their employment with the University.
2. Objective
2.1 Education and training plays a key role in ensuring a culture of professional and ethical conduct, while minimising legal, financial, physical and psychological risks to Staff Members and the University.
2.2 Mandatory training will:
a. Outline University principles, clarify expectations and the law (where relevant) as it relates to the subject matter.
b. Cover key policies and concepts.
c. Articulate and contextualise the responsibilities and obligations of Staff Members and Supervisors.
2.3 Divisions, Colleges and Directorates may establish their own training requirements that are tailored to the activities of the organisational unit. These additional training requirements must not duplicate the training identified as being part of the Mandatory Training suite covered by this Policy.
3. Responsibilities
3.1 The University Executive is responsible for identifying, creating and providing opportunities for training in support of the University’s goals and objectives.
3.2 Supervisors share responsibility for ensuring Staff Members complete their Mandatory Training requirements within the specified time frames, and for taking appropriate action to ensure compliance among the Staff Members under their supervision.
3.3 Staff Members are responsible for understanding their obligations under this Policy, and ensuring that they are compliant with the Policy and relevant Procedures.
3.4 The Director, Human Resources is responsible for facilitating the provision of education and information with respect to Mandatory Training for Staff Members, keeping accurate records of participation in Mandatory Training, and monitoring the effectiveness of this Policy and its associated Procedures.
4. Consequences of non-compliance
4.1 Where a Staff Member does not undertake the Mandatory Training within the required timeframes, the matter will be treated in accordance with the All Staff Mandatory Training Procedure and the JCU Enterprise Agreement.
5. Reporting
5.1 Mandatory training status reports will be provided to the University Executive and through relevant Council Committees on a quarterly basis for monitoring and discussion.
