Emergency Mental Health Laws

With Alan Clough, James Cook University

Law Seminar Series - Emergency Mental Health Laws in Qld

Thursday 17 October 2024
Where: Online & Bld A1, Room 16, JCU Cairns, Nguma-bada Campus, Smithfield

Join us for a compelling presentation with Professor Alan Clough, on the critical role of Emergency Examination Authorities (EEAs) in Queensland, governed by the Public Health Act 2005 (PHA) and the Mental Health Act 2016 (MHA). Each year, tens of thousands of individuals with severe disturbances in mental capacity require urgent care in emergency departments. While most are treated under the PHA, focusing on protecting public health by transporting individuals to treatment facilities, about one in five are treated under the MHA, emphasising the least restrictive care for those with mental illness. This seminar will explore Parliament’s rationale for these distinct pathways, assess the effectiveness of these laws, and examine their human rights implications. Don’t miss this chance to understand the complexities of mental health care in emergency situations.
